These Terms & Conditions apply to all yoga classes, courses, programmes, workshops, digital content, live classes and 1:1 coaching services provided under the YogaLee brand.

YogaLee is a trading name of The Passion Fruit Tree Ltd, a company registered in England and Wales.

In these Terms, “YogaLee”, “we”, “us” or “our” means The Passion Fruit Tree Ltd, trading as YogaLee. “You” or “your” means the person purchasing or participating in our services.

By purchasing, accessing or participating in any YogaLee course, class or coaching service, you confirm that you have read and understood these Terms & Conditions and the Health & Safety information below.

 

1. About YogaLee

YogaLee provides yoga movement, yoga education and general wellbeing services, which may include:

  • prerecorded yoga classes;

  • prerecorded mini-courses and programmes;

  • beginner yoga courses;

  • live online yoga and movement classes;

  • workshops and educational content; and

  • 1:1 yoga movement and wellbeing coaching.

The exact content, format, duration and availability of each product or service will be described on the relevant sales, booking or checkout page.

YogaLee may introduce additional products and services in the future, including memberships or subscription programmes. Where this happens, the applicable pricing, renewal, cancellation and other terms will be provided before you purchase.

 

2. Our qualifications and scope of services

YogaLee's yoga services are provided by a 200-hour certified Vinyasa Flow yoga teacher.

Our services are focused on yoga movement, physical practice, education and general wellbeing.

YogaLee and The Passion Fruit Tree Ltd do not provide medical or healthcare treatment through our yoga courses, classes or coaching services.

Our services are not:

  • medical advice;

  • medical treatment;

  • physiotherapy;

  • psychotherapy;

  • counselling;

  • chiropractic treatment;

  • diagnosis of a medical condition;

  • injury rehabilitation; or

  • a substitute for professional healthcare.

Our 1:1 coaching is intended to provide personalised yoga movement guidance, education and general wellbeing support. It does not create a therapist-client, doctor-patient or other healthcare professional relationship.

We do not diagnose medical conditions or prescribe medical treatment.

 

3. Health & Safety

Yoga and physical movement are forms of physical activity and involve inherent risks.

These may include, but are not limited to, muscle soreness, strains, sprains, falls, aggravation of an existing injury and other physical injury.

You are responsible for deciding whether participation is appropriate for you and for working within your own physical capabilities.

You should seek appropriate medical or professional advice before participating if you:

  • have an existing injury or medical condition;

  • have recently undergone surgery or medical treatment;

  • are pregnant or have recently given birth;

  • have been advised by a healthcare professional to restrict or modify physical activity;

  • experience unexplained pain, dizziness, fainting, chest pain or unusual shortness of breath; or

  • are unsure whether yoga or physical exercise is appropriate for you.

If you are unsure whether a particular movement or class is suitable for you, please seek advice from an appropriately qualified healthcare professional before participating.

 

4. Listen to your body

YogaLee classes are intended to support movement and wellbeing, not to encourage you to push through pain or ignore physical warning signs.

You should:

  • work at a level appropriate for your own ability;

  • modify or skip movements when necessary;

  • take breaks whenever you need them;

  • use appropriate equipment where required;

  • ensure that your environment is safe before beginning a class; and

  • stop exercising if you experience pain, dizziness, nausea, unusual shortness of breath or any other concerning symptoms.

You should never feel that you need to perform a movement simply because it is demonstrated or instructed during a YogaLee class.

If something does not feel right, stop.

 

5. No medical or therapeutic advice

The information and guidance provided through YogaLee are for general educational, movement and wellbeing purposes.

Nothing provided through YogaLee should be interpreted as medical advice, diagnosis or treatment.

You should not rely on YogaLee content as a substitute for advice from your doctor, physiotherapist, mental health professional or other suitably qualified healthcare professional.

If you have a health concern, injury or medical condition, please seek appropriate professional advice.

 

6. 1:1 yoga movement and wellbeing coaching

Our 1:1 sessions may involve personalised yoga movement guidance, discussion of your goals, movement preferences and general wellbeing.

You are responsible for providing accurate and relevant information about your physical abilities, limitations and any circumstances that may affect your ability to participate safely.

We may modify or avoid particular movements based on information you provide.

However, this does not constitute a medical assessment, diagnosis or treatment.

We may recommend that you seek advice from an appropriate healthcare professional where we believe this would be appropriate.

We reserve the right to decline, pause or discontinue a coaching session if we reasonably believe that continuing may be inappropriate or unsafe.

 

7. Health information

If you choose to provide information about injuries, medical conditions, pregnancy, physical limitations or other health circumstances as part of a 1:1 coaching service, this information may constitute health information and may receive additional protection under applicable data-protection law.

We will handle personal information in accordance with our Privacy Policy.

8. Pre recorded courses and classes

Prerecorded YogaLee courses and classes are designed to be completed independently.

Before participating, you are responsible for ensuring that:

  • you have sufficient space to move safely;

  • your floor and surroundings are appropriate for exercise;

  • any equipment you use is safe and suitable;

  • you have considered whether the class is appropriate for your ability and circumstances; and

  • you are able to participate without unnecessary hazards or distractions.

The fact that a movement is demonstrated in a YogaLee course does not mean that it is suitable for every individual.

You should choose appropriate modifications and skip movements that do not feel suitable for you.

 

9. Live classes

Live online classes involve additional considerations because we cannot continuously monitor your physical environment or every aspect of your movement.

Before participating, please make sure that you have:

  • sufficient space to move safely;

  • suitable and stable equipment where required;

  • an appropriate floor and environment;

  • sufficient lighting and visibility; and

  • access to water and anything else you reasonably need during the class.

We may provide verbal or visual guidance during a live class, but you remain responsible for deciding whether and how to perform each movement.

 

10. No guarantee of results

Yoga and movement affect different people in different ways.

We do not guarantee any particular physical, fitness, flexibility, strength, weight, wellbeing or other result from participating in YogaLee services.

Any benefits, examples, testimonials or outcomes described on our website or in our marketing are illustrative and are not guarantees of individual results.

Your results will depend on many individual factors, including your starting point, consistency, lifestyle, physical condition and other circumstances.

 

11. Purchasing YogaLee products

The price of each product or service will be displayed before you purchase.

All prices will be stated in the applicable currency and will include VAT where required by law.

The sales or booking page will explain what is included in each product or service.

We take reasonable care to ensure that product descriptions and pricing are accurate. If we discover an obvious error in a product description or price, we will contact you and take appropriate steps to correct the error.

 

12. Digital content and immediate access

Some YogaLee products consist of digital content, including prerecorded classes, courses, videos, programmes and other downloadable or online materials.

Where digital content is supplied immediately after purchase, you may be asked to expressly consent to the digital content being supplied before the end of the applicable cancellation period and to acknowledge the effect this may have on your statutory cancellation rights.

Your statutory consumer rights are not affected by these Terms & Conditions.

 

13. Cancellation and refunds

Nothing in these Terms & Conditions affects any statutory consumer rights that cannot legally be excluded.

Where UK consumer cancellation rights apply, you may have a statutory 14-day cancellation period.

Different rules may apply to digital content and services where:

  • you request that a service begins during the cancellation period; or

  • you expressly consent to immediate access to digital content and acknowledge the effect this may have on your cancellation rights.

Any specific cancellation or refund arrangements applicable to your purchase will be communicated before or at the point of purchase.

We will deal with cancellation and refund requests in accordance with applicable consumer law and the terms applicable to your purchase.

 

Digital Courses - Immediate Access and cancellation

Immediate access to prerecorded courses

 

Our prerecorded YogaLee courses and digital programmes are designed to provide immediate access following successful payment.

When purchasing a prerecorded course, you will be asked to expressly confirm that you:

  1. request and consent to the digital content being made available to you immediately after purchase; and

  2. understand and acknowledge that, once we begin supplying the digital content, you may lose your statutory 14-day cancellation right in respect of that digital content.

By giving this express consent and acknowledgement, you agree that you cannot subsequently cancel the purchase simply because you have changed your mind once access to the digital course has been provided, subject always to any statutory rights that cannot legally be excluded.

Refunds for prerecorded courses

Because access to prerecorded digital content is provided immediately following purchase, we do not offer refunds for change of mind once access to the course has been supplied, where you have expressly consented to immediate access and acknowledged the resulting effect on your cancellation rights.

This does not affect your statutory consumer rights.

If the digital content is faulty, does not match its description, is not supplied as promised, or you experience another issue covered by applicable consumer law, please contact us at vanessa@yogalee.co.uk and we will consider the appropriate remedy.

If you experience a technical problem preventing you from accessing content you have purchased, please contact us and we will make reasonable efforts to resolve the issue.

Before you purchase

The sales page for each prerecorded course will clearly explain that:

  • the course provides immediate digital access;

  • access begins following successful payment; and

  • you will be asked to consent to immediate supply and acknowledge the effect this has on your statutory cancellation rights.​

Nothing in these Terms & Conditions is intended to remove or restrict any consumer right that cannot legally be excluded.

 

14. 1:1 coaching cancellations and rescheduling

For 1:1 sessions, we ask that you provide at least 24 hours' notice if you need to cancel or reschedule.

Where sufficient notice is provided, we will offer a rescheduled session / provide a credit / provide a refund, subject to the terms communicated at the time of booking.

If you do not attend a booked session or cancel with less than 24 hours' notice, the session will normally be treated as used and will not be eligible for a refund or rescheduling. However, we may use our discretion to offer a rescheduled session in exceptional circumstances, such as illness or an emergency.

We may need to cancel or reschedule a session due to illness, emergency, technical problems or circumstances outside our reasonable control.

Where this happens, we will offer an alternative session or appropriate refund or credit.

Nothing in this section affects your statutory consumer rights.

 

15. Technical requirements

For online classes and digital courses, you are responsible for having:

  • a suitable internet connection;

  • a compatible device;

  • access to any required software or platform; and

  • any equipment identified as necessary for the particular class.

We are not responsible for problems caused solely by your device, internet connection, software or other equipment that is outside our reasonable control.

Where a technical problem on our side prevents you from accessing a product or service you have purchased, we will take reasonable steps to restore access or provide an appropriate alternative.

 

16. Intellectual property

All YogaLee content and materials remain the intellectual property of The Passion Fruit Tree Ltd or our relevant licensors unless expressly stated otherwise.

This includes, but is not limited to:

  • videos;

  • recordings;

  • photographs;

  • graphics;

  • written materials;

  • course materials;

  • yoga programmes;

  • teaching materials;

  • website content; and

  • other educational resources.

When you purchase a YogaLee product, you receive a personal, non-exclusive, non-transferable right to access and use the content for your own personal use.

You must not, without our written permission:

  • copy or reproduce our content;

  • redistribute or resell our content;

  • upload our content to another website or platform;

  • share your account or login details with another person;

  • record live classes for distribution;

  • use our content to create a competing commercial product; or

  • present our teaching materials as your own.

 

17. Personal use and account sharing

YogaLee courses and paid content are intended for the individual who purchased them unless otherwise stated.

You must not allow another person to access paid content through your account.

If we reasonably believe that an account is being shared, misused or used in breach of these Terms, we may suspend or restrict access while we investigate.

This does not affect any statutory consumer rights.

 

18. Our responsibility and liability

We will provide our services with reasonable care and skill.

Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited.

In particular, nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

Subject to the above, we are not responsible for loss or damage arising from circumstances outside our reasonable control or from your failure to follow reasonable safety instructions.

Nothing in these Terms & Conditions affects your statutory consumer rights.

 

19. Your responsibility when participating

By participating in a YogaLee course, class or coaching session, you acknowledge that:

  • physical activity carries inherent risks;

  • you are responsible for deciding whether participation is appropriate for you;

  • you will work within your own capabilities;

  • you will follow reasonable safety instructions;

  • you will modify or stop exercises when necessary; and

  • you will seek appropriate professional advice where you have concerns about your ability to participate safely.

You should never feel pressured to continue an exercise that feels unsafe or unsuitable.

 

20. Changes to our services

We may make reasonable changes to our courses, classes or services from time to time, including changes to content, instructors, platforms or scheduling.

Where a significant change materially affects a product or service you have already purchased, we will take reasonable steps to notify you and, where appropriate, provide an alternative or remedy in accordance with applicable consumer law.

 

21. Changes to these Terms

We may update these Terms & Conditions from time to time to reflect changes to our services, business or applicable law.

The version of the Terms applicable to your purchase will normally be the version made available to you before you purchase.

We will not use a subsequent change to remove rights you have already acquired under an existing purchase.

 

22. Privacy

We collect and process personal information in connection with providing YogaLee services.

Our Privacy Policy explains:

  • what information we collect;

  • why we collect it;

  • how we use it;

  • how we store and protect it;

  • who we may share it with; and

  • your rights in relation to your personal information.

We will make reasonable efforts to investigate and resolve complaints fairly and promptly.

 

24. Governing law

These Terms & Conditions are governed by the law of England and Wales, unless applicable consumer law requires otherwise.

If you are a consumer, you retain any mandatory rights and protections available to you under applicable law.

If you have an injury, medical condition, are pregnant or have recently given birth, have recently undergone surgery or medical treatment, or have any concerns about whether yoga or a particular movement is suitable for you, please seek appropriate advice from a qualified healthcare professional before participating.

Work within your own ability and modify or skip movements whenever necessary.

If you experience pain, dizziness, fainting, chest pain, unusual shortness of breath or any other concerning symptoms, stop the activity and seek appropriate medical attention.

You are never required to perform a movement simply because it is demonstrated or instructed during a YogaLee class.

By participating, you acknowledge that you have read and understood this Health & Safety information and agree to take reasonable responsibility for your own participation and safety.

 

Acceptance of Terms

By purchasing or booking a YogaLee product or service, you confirm that you have had the opportunity to read these Terms & Conditions and the Health & Safety information.

Where required, you will be asked to actively confirm your acceptance of these Terms before completing your purchase.
